Il saggio affronta il tema dell’obbligo di formazione, come introdotto dall’art. 2103, comma 3, c.c., nella sua ultima formulazione. In particolare, la corretta collocazione sistematica della piú recente normativa e il rilievo dei problemi interpretativi ed applicativi di quella precedente costituiscono le premesse necessarie per l’esegesi della nuova disposizione, al fine ultimo di comprenderne il significato e di chiarire la natura delle posizioni giuridiche soggettive di datore e prestatore di lavoro con riferimento alla formazione.
The essay deals with the subject of the training obligation, as introduced by art. 2103, third paragraph, of the Italian Civil Code, in its latest formulation. In particular, the correct systematic interpretation of the most recent legislation and the importance of the interpretative and applicative problems of the previous one constitute the necessary premises for the exegesis of the new provision, with the ultimate aim of understanding its meaning and clarifying the nature of the subjective legal positions of employer and employee with reference to the obligation to train.
