New ways of protection of collective interests: the Italian class litigation and arbitration through a comparative analysis

Abstract

The primary project in this Article is to analyze the various components of the protection of collective interests and to study their relationship. The second aim is to outline a proposal for enhancing the existing Italian system of protection of individual interests when they are intertwined with collective interests. Through a comparative analysis, that proposal requires Italian legal system to enhance the existing rules on class litigation and to authorize the class-wide arbitration.
