The conundrum of judicial accountability and independence in military courts from a comparative perspective
Accountability of judicial power : theoretical and comparative perspectives, 2025Abstract
This work analyzes independence and accountability in the specific context of military jurisdiction. It takes Italy as a case-study and places it in the comparative scenario, elaborating some models through the study of how the same issue is regulated in other countries belonging to both the civil law and the common law tradition. In its conclusion, the chapter examines whether and how independence, impartiality and accountability are guaranteed in practice in the jurisdictions at stake as far as military courts are concerned.
